Changing your TIE category after marriage or a child in Spain

How to switch your Spanish residence card to the family-member-of-a-Spaniard category after marrying or having a child, and why the foreign certificate must first be registered with Spain's Civil Registry.

If you already hold a Spanish residence card and marry a Spanish citizen or have a child together, you can apply to switch your TIE category to "family member of a Spanish citizen" — a category with better conditions (a 5-year card, direct access to work). The procedure itself is straightforward, but it almost always stalls on a step most people don't anticipate: the marriage or birth certificate must already be registered with Spain's Civil Registry, not just the foreign original.

The step before: registering the certificate with Spain's Civil Registry

If you married outside Spain, or your child was born outside Spain, the foreign certificate (marriage or birth) first gets translated by a sworn translator and apostilled, and with that you apply for registration with the Spanish Civil Registry — consular, if you married abroad and are still there, or at the Civil Registry of your address in Spain, if you already live here. Only the certificate that's already registered, issued by the Spanish Civil Registry, works for the TIE category change.

If you married in Spain, or your child was born here, this step doesn't apply: the Spanish certificate is already ready to use directly.

Documents for the category change

  • Form EX-17, the TIE application.
  • Proof of fee payment (form 790, code 012).
  • Marriage certificate issued by the Spanish Civil Registry, if the change is due to marrying a Spanish citizen.
  • Birth certificate of the shared child, if the change is due to having a child with a Spanish citizen.
  • Passport and current TIE, valid.

Common mistakes

  1. Submitting the foreign marriage certificate directly, without having it registered first with the Spanish Civil Registry — this is the most common reason this application gets rejected.
  2. Not translating the certificate before requesting registration. The Civil Registry requires sworn translation and apostille of the foreign document to register it, not the other way round.
  3. Confusing this with family reunification — these are different procedures: here you're already a resident in Spain and switching category; with family reunification you're bringing a family member in from abroad.
  4. Tight deadlines: booking the appointment for the category change before the registry entry is ready usually means having to repeat the process.
