1. Purpose and acceptance
These General Terms of Service (hereinafter, "GTS") govern the contractual relationship between Eva Moreno Ortiz (hereinafter, "Textualia" or "the Provider"), Tax ID ES52771554D, with address at Calle Alcalde Josep Poveda Verdú, 3 · 03560 El Campello (Alicante), Spain; and the individual or legal entity (hereinafter, "the Customer") that requests and contracts the sworn-translation services offered through the website https://textualia.com.
Placing an order through the website constitutes express and unreserved acceptance of these GTS, as well as of the Legal notice and the Privacy policy, which the Customer declares to have read and understood.
2. Services offered
Textualia offers professional sworn-translation services, consisting of the translation of documents between Spanish and English or French, in either direction, certified with the signature and seal of a translator accredited by Spain's Ministry of Foreign Affairs, European Union and Cooperation (MAEC), with full legal validity before administrations, courts, universities, notaries and registries in Spain.
The service is provided entirely online. The Customer uploads the document to be translated or indicates the number of pages through the quote tool available on the website, and receives the digitally signed sworn translation within the agreed turnaround time.
3. Contracting process
The contracting process takes place in the following stages:
a) Quote request. The Customer accesses the quote tool and uploads the original document or indicates the number of pages. The system calculates the final price of the service, including, where applicable, additional options such as physical delivery.
b) Order configuration. The Customer selects the delivery turnaround (standard, urgent or express), optionally adds delivery of a physical copy by courier, and enters the billing details.
c) Payment. The Customer pays online via the secure Stripe gateway. Accepted payment methods include credit or debit card (Visa, Mastercard, American Express), Bizum, Apple Pay, Google Pay and Amazon Pay.
d) Confirmation. Once payment has been processed, the Customer receives a confirmation email with the order number and details of the order.
e) Delivery. Textualia carries out the translation and delivers it to the Customer, within the agreed turnaround time, by email to the address provided, as a digitally signed PDF. If the Customer has ordered a physical copy, it is sent by courier to the address indicated.
4. Price and payment method
The applicable rates are those published in the website's quote tool at the time of contracting. The customer knows the exact price before confirming payment.
General pricing structure:
- Per-page rate: fixed amount per billable page, with three tiers depending on turnaround (standard, urgent and express).
- Minimum order: one page.
- Physical copy delivery (optional): cost depending on destination, shown at checkout before payment.
A billable page is equivalent to a maximum of 300 words. When a document contains more words than would fit on its physical pages, the number of billable pages is calculated by content equivalence: billable pages = total word count of the document divided by 300, rounded up.
All prices shown to the customer in the quote tool, checkout and confirmation include applicable VAT. The invoice issued by Textualia itemises the taxable base and VAT amount in accordance with applicable tax regulations. For businesses with a valid intra-EU VAT number, the corresponding exemption will apply.
Payment is made entirely in advance via the Stripe gateway. Until payment is confirmed, the order is considered "pending" and the service is not begun.
5. Delivery turnaround
Textualia offers three delivery turnaround tiers — standard, urgent and express — calculated according to the Spanish working calendar (national holidays and those of the Valencian Community and Alicante). The exact delivery date is shown to the customer in the quote tool before payment is confirmed.
Turnaround times are guaranteed, not estimates.
If, for exceptional reasons not attributable to the Customer, Textualia is unable to meet the contracted delivery turnaround, it will notify the Customer as far in advance as possible and refund the Customer the price difference between the contracted turnaround and the turnaround in which delivery is ultimately made.
6. Legal validity of the translation
Sworn translations delivered by Textualia carry an official electronic signature and have full legal validity in Spain under Order AUC/213/2025, of 26 February, of the Ministry of Foreign Affairs, on the electronic signature of sworn translations, as well as under Regulation (EU) 910/2014 (eIDAS).
The official electronic signature has the same legal effects as a handwritten signature and is accepted by virtually all Spanish administrations. If the Customer knows in advance that their procedure requires a physical copy, they may order it as an additional option.
7. Confidentiality and data processing
Textualia treats the Customer's documents with absolute confidentiality. Original documents are deleted from Textualia's systems immediately after the translation is delivered, in accordance with our Privacy policy.
Access to documents during service delivery is restricted to personnel strictly necessary for its performance.
8. Right of withdrawal
In accordance with Article 103.a of Royal Legislative Decree 1/2007, approving the consolidated text of the General Law for the Defence of Consumers and Users, the right of withdrawal does not apply once performance of the service has begun, where the Customer has expressly consented to its immediate commencement.
By confirming the order and making payment, the Customer gives express consent for Textualia to begin performing the service immediately and acknowledges that they lose the right of withdrawal once performance has been completed.
However, before translation has effectively begun, the Customer may cancel the order by writing to info@textualia.com and will be refunded the full amount paid. If the translation has already begun, the proportional part not yet performed will be refunded.
9. Guarantee and rejection by an authority
If a Spanish public authority, court, university, notary or registry rejects a sworn translation delivered by Textualia for formal reasons attributable to the translation itself (missing seal, incorrect signature, lack of certification, material error, etc.), Textualia will, at no additional cost to the Customer:
- Correct the document and deliver the corrected version.
- Or fully refund the amount paid, at the Customer's choice.
This guarantee does not cover rejections arising from causes unrelated to the translation, such as:
- An expired original document, or one lacking an apostille where required.
- An original document in a format not accepted by the authority.
- Additional procedure-specific requirements that were not communicated to Textualia.
- A change in regulations or administrative criteria after delivery.
In such cases, Textualia may offer the Customer guidance on the steps to follow, without this implying any obligation to refund or to correct free of charge.
10. Limitation of liability
Without prejudice to the specific guarantee in clause 9 above, and to the liability that in any case applies under Articles 1102 and 1103 of the Spanish Civil Code, Textualia's total liability towards the Customer for any claim arising from the provision of the service — whether for breach of contract, negligence or any other cause — is limited, at most, to twice the amount actually paid by the Customer for the specific order giving rise to the claim.
This limit does not apply, and Textualia's liability will be that which corresponds under applicable law without any limitation, in the following cases:
- Damage caused by wilful misconduct or gross negligence on the part of Textualia.
- Personal injury (death or physical harm) that may arise from Textualia's actions.
- Any other case in which applicable law — in particular the consolidated text of the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007) — does not permit limiting or excluding liability towards a Customer who has the legal status of a consumer.
In any event, and within that limit, Textualia will not be liable for indirect damages, loss of profit, loss of opportunity or other harm arising from the Customer's or third parties' use of the translated document.
This clause does not affect the rights that applicable law grants on a non-waivable basis to a Customer who has the legal status of a consumer, and it will apply only to the extent permitted by such law.
Textualia is not liable for delays, errors or consequences arising from failures in courier services, emails not received by the Customer for technical reasons beyond Textualia's control (spam filters, email provider issues, etc.), or any other cause of force majeure.

The Customer may also consult the European Commission's directory of consumer dispute-resolution bodies, available at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies_en, to locate the competent body in their country. The former EU Online Dispute Resolution (ODR) platform ceased to operate on 20 July 2025.
12. Amendments
Textualia reserves the right to modify these GTS at any time. Amendments will take effect from their publication on the website. Orders already confirmed before an amendment will remain subject to the GTS in force at the time of contracting.
13. Applicable law and jurisdiction
These GTS are governed by Spanish law. For the resolution of any dispute arising from the provision of the service, the parties submit to the Courts of the Customer's domicile when the Customer acts as a consumer; in all other cases, to the Courts of Alicante (Spain).
