If you come from Quebec and need to prove your birth, marriage or civil union before a Spanish office —a civil registry, an immigration office, a notary—, there is one quirk that works in your favour and is worth grasping before you start: since 2022, all Quebec civil status acts are drawn up in French only. For Spain that means a direct French-to-Spanish sworn translation, with no detour through English. One intermediary fewer, one source of error fewer.
A single issuer since 1994: the Directeur de l'état civil
In Quebec, do not look for your birth record at the parish or the town where you were born. Since 1 January 1994, when the Civil Code of Québec came into force, there is a single body that registers and issues civil status acts: the Directeur de l'état civil. On that date, the 17 million acts previously kept by thousands of ministers of religion and prothonotaries across the province were consolidated into one register.
The Directeur de l'état civil is the sole issuer of four types of act:
- Acte de naissance (birth)
- Acte de mariage (marriage)
- Acte d'union civile (civil union)
- Acte de décès (death)
Whatever your procedure in Spain, the document comes from here. There is no other counter.
Certificate or copy of an act: for Spain, order the copy of the act
This is where most people order the wrong thing, and re-requesting it from Spain costs time. The Directeur de l'état civil issues two distinct formats of the same event:
- The certificate (certificat) is an extract: it contains the principal information from the act, enough for most dealings within Canada.
- The copy of an act (copie d'acte) is the complete, full reproduction of the act as it appears in the register.
For a procedure in Spain —registration in the civil registry, a marriage file, a succession before a notary— you will usually be asked for the complete document, that is, the copie d'acte. Order it from the outset. If you request the certificate and the Spanish office wants the full copy, you have to start the Canadian circuit all over again.
French only since June 2022 (and why that helps you)
Quebec acts used to be available in English or in bilingual format. Not any more. With the entry into force of the Act respecting French, the official and common language of Québec (the reform of the Charter of the French Language, known as Bill 96), since 1 June 2022 all acts issued by the Directeur de l'état civil are drawn up exclusively in French. You may complete the request form in English, but the act you receive comes in French.
For your Spanish procedures this simplifies matters: Spain only accepts translations signed by a sworn translator accredited by the MAEC (the Spanish Ministry of Foreign Affairs), and your French act is translated directly into Spanish. A certified translation produced in Canada, even by an OTTIAQ member, has no standing before the Spanish administration.
The apostille: available since 11 January 2024, and done in Quebec
The other requirement is the apostille, which authenticates the document so Spain will recognise it. Canada joined the Hague Convention and the apostille has been operational since 11 January 2024. The convenient part for a Quebecer is that Quebec apostilles its own provincial documents: the copie d'acte from the Directeur de l'état civil is apostilled in Quebec, before the Ministère de la Justice du Québec, without going through Ottawa.

The Quebec civil union and the Spanish pareja de hecho
The union civile is a Quebec institution, created in 2002, open to same-sex and opposite-sex couples, with effects very close to those of marriage within the province. When you enter into it, the Directeur de l'état civil draws up an acte d'union civile, the official document that proves it.
Do not confuse it with the Quebec union de fait, which is a cohabitation without a civil status act and is closer to the Spanish pareja de hecho (registered partnership). If you need to prove your situation in Spain —for registration as a couple, a marriage file or family reunification—, what gets translated and apostilled is the specific act you hold: the acte d'union civile if you are in a civil union, or the acte de mariage if you married. The exact equivalence with the Spanish figure is assessed by the office handling your case; our job is to deliver the document translated with precision, preserving the original legal term.
