Ireland is an EU member state, so you might expect an Irish spouse's paperwork to be among the simplest. In part it is: the birth certificate doesn't need an apostille. But the document that proves you're free to marry follows a distinctly Irish process — built on statutory declarations, not a simple certificate issued on the spot — worth understanding before you start.

The Irish spouse's documents
Identity and birth
- A valid Irish passport.
- A long-form birth certificate, issued by Ireland's General Register Office (GRO), with full parentage details. The short card-style version usually isn't enough.
Freedom to marry: the Certificate of Freedom to Marry
Here's the piece that raises the most questions. Ireland doesn't issue an instant "single status certificate" over the counter: the process is called the Certificate of Freedom to Marry, handled by Ireland's Department of Foreign Affairs (DFA) through an online system:
- You complete an online questionnaire about the applicant and the planned marriage.
- Based on your answers, the system generates one or more statutory declarations, which need to be signed before a witness in the country where you're ordinarily resident — in Madrid, Barcelona or wherever you currently live in Spain.
- You attach whatever supporting documentation the questionnaire asks for: usually a copy of your passport and, if you were previously married, your divorce or widowhood documentation.
Deadlines to respect: the application must be submitted at least four months before the wedding date, and the statutory declaration can't be dated more than six months before that date. Applying with 28 days or less of lead time carries an extra fee for the rushed processing.
If there was a previous marriage
- A Decree Absolute or divorce judgment from the Irish court (or the country where it was issued, if the marriage wasn't in Ireland), apostilled and sworn-translated.
- In case of widowhood: a death certificate for the deceased spouse, issued by the GRO if the death occurred in Ireland.
Local registration
- A certificado de empadronamiento for each spouse if the couple already lives in Spain.
Apostille: yes for some documents, confirm for others
Ireland and Spain are both EU member states, so EU Regulation 2016/1191 applies to several of these documents — see our full explainer on when an EU document doesn't need an apostille. In practice:
- The GRO birth certificate doesn't need an apostille. Birth is expressly covered by the regulation between EU countries.
- The Certificate of Freedom to Marry falls, in theory, within the "capacity to marry" category also covered by the regulation. But since it's built from statutory declarations rather than a single standardised certificate, practice varies between Spanish civil registries: some accept it without an apostille, others still ask for one out of caution. Confirm with your specific civil registry before ruling out the apostille — the same advice applies to the rest of the file, since each registry sets its own criteria.
- Decree Absolute and death certificates from Irish courts, where there was a previous marriage or widowhood, usually still need an apostille as court documents.
Sworn translation: almost always needed
Even when a document is exempt from the apostille under the EU regulation, that doesn't automatically exempt it from translation — only the multilingual standard form does that, and it has to be specifically requested from the issuing body. In practice, neither the GRO nor the DFA routinely attaches that form to these documents. Just as with the Irish Police Certificate, the Spanish civil registry will typically ask for a sworn Spanish translation by a translator accredited by the MAEC for the whole file, apostilled or not.
The exact requirements are set by each civil registry
There's no single list valid across Spain: each civil registry applies its own criteria on formats, validity periods (usually 6 months) or supporting documents. Before starting the Certificate of Freedom to Marry process — which, remember, needs four months' notice — check the specific list from your registry.
